At Survail, we take customer privacy seriously.

 

This Privacy Statement for Survail Products and Services (“Privacy Statement”) describes information that Survail Inc. and its subsidiaries and affiliates (collectively, “Survail”) collect, use, share, and store, including personal information (i.e., information that personally identifies you, such as your name or email address, or other data that can be reasonably used to infer this information) and is incorporated by reference into the Survail Terms of Service.

 

This document provides information regarding how we collect and use information from our public web sites, including www.Survail.com (collectively, the “Websites”) and from the operation of Survail products and services, including Survail security cameras and its web application (collectively, the “Survail Products.”).

 

Our Pledge on Privacy

 

We will be transparent about the different types of information we collect and how we use them. We will ask your permission before sharing your personal information with third parties for purposes other than the purpose for which the information was originally requested, or to provide Survail’s Products, and to do so only when we think they will provide you with a welcome additional service.

 

We will use best-in-class data security tools and best practices to keep your data safe and protect the Survail Products from unauthorized access.

 

Your Consent - Consent to data collection and processing

 

By using Survail Products or browsing the Websites, you agree to allow us to collect and process information as described in this Privacy Statement.

 

Consent to international data transfers

 

Your personal information may be collected, processed, and stored by Survail or its service providers in the United States and other countries where our servers reside. Please be aware that the privacy protections and legal requirements, including the rights of authorities to access your personal information, in some of these countries may not be equivalent to those in your country. If you are using Survail Products or browsing the Websites in Europe or other regions with laws governing data collection and use that may differ from United States law, you consent to the transfer of your personal data to the United States and other countries where Survail operates. For more information about transfers of personal information from the EU to the US, please see the section below, entitled “EU-US and Swiss-US Privacy Shield Frameworks.”

 

What information do Survail websites collect?

 

The Websites collect anonymous data as well as personal information. We do not collect personal information without you first taking an action that demonstrates your prior consent — such as clicking a “submit” button on a web form.

 

Any time you enter personal information in a form on one of the Websites, we collect that information and store it on servers that are encrypted and maintained by our data center partners or those of our third party vendors. Examples of personal information that you provide when submitting a form include:

Phone number

Email address

Mailing address

Information about your business

Your stated preferences

 

When this happens we also set a cookie that enables us to enhance your use of the Websites, for example by pre-populating your information in another Survail online form you may complete in the future.

 

Like most Internet sites, the Websites routinely record log entries and technical information when your browser, mobile device, or Survail Product contacts our servers, including:

 

Inferred location

Browser type and version

Device type

Referring domain

Other anonymous metadata inferred from your web session

In addition to the aforementioned data, cookies may be stored on your computer when you browse the Websites. We use cookies primarily to determine how visitors engage with the Websites (e.g., the pages you view, the links you click, how frequently you access the Websites, the number of visits over time, etc.).  Cookies are small text files that are stored on your hard drive or assigned to your web browser that enable us to enhance your experience of the Websites. Cookies can not run programs or transmit viruses to your computer. They serve to make the Websites more user-friendly and effective overall.

 

We may also use clear gifs in HTML-based emails sent to our users or other contacts in order to track which emails are opened and which links are clicked by recipients. This information allows for more accurate reporting and improvement of the websites, the Survail Products, and our marketing efforts. We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends of the websites and Survail Products. These tools collect information sent by your browser or mobile device, including the pages you visit, your use of third party applications, and other information that assists us in analyzing and improving the websites and Survail Products.

 

You can “opt out” of the collection of any information through cookies or other tracking technology by actively managing the settings on your browser or mobile device. Please refer to your browser’s or mobile device’s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Lastly, we may permit third party ad networks, social media companies, and other third party services to collect information about browsing behavior from visitors to our Websites through cookies, social plug-ins, or other tracking technology. We may permit third party online advertising networks to collect information about your use of our Websites over time so that they may display ads that may be relevant to your interest in Survail or the Survail Products on other websites or services. Typically, the information is collected through cookies or similar tracking technologies.



Is information shared with or received from third parties, outside of Survail?

 

Survail shares information collected by Survail Products with third-party vendors with which we contract to provide the service. For more detail, please see the section below, entitled, “In what circumstances does Survail share my information?”

 

Survail may share information with third parties with your permission. For example, when you enroll in a promotional program for Survail Products offered in partnership with Survail partners, you may be asked for your permission to share certain data between Survail and our partner. Or, if you require installation services, we may with your permission share your contact information with a Survail Partner to provide these services. Survail requires your consent before sharing information in these circumstances, and Survail remains responsible for the actions of any third party to which it transfers your information.

 

Any Survail data that you choose to share with a third party is governed by that third party’s privacy policy while in that party’s possession.

 

Any data that Survail receives from third-parties will be processed and stored by Survail and will be treated in accordance with this Privacy Statement. This information may be processed in the same ways as any other data that is a part of your Survail account or the Survail logs.



How does Survail use the information it collects?

 

We use the information we collect to provide, develop and improve the Survail products and services, including to make assessments and recommendations about products, safety, or security enhancements. We may use your contact details to send you this information, or to ask you to participate in surveys about your Survail use, and to send you other communications from Survail.

 

We may also use this information in an aggregated, non-identified form for research purposes and to help us make sales, marketing, and business decisions. For example, we may use aggregated user information about the number of active camera users in a particular state to help us decide where additional Survail partners may enable us to improve customer support and service.

 

We may use service providers to perform some of these functions. Those service providers are restricted from sharing your information for any other purpose.

 

We use industry-standard methods to keep this information safe and secure while it is transmitted over your local area network and through the Internet to our servers. Depending on your location and type of data, Survail may process your personal information on servers that are not in your home country.

 

In what circumstances does Survail share my information?

 

Under no circumstance do we share personal information for any commercial or marketing purpose unrelated to the activation and delivery of Survail Products and services without asking you first. Period. We do not rent or sell our customer lists.

 

The following are the limited situations where we may share personal information:

 

With your consent
 
We may share personal information when we have your consent. One example of this would be if you invite another user to access the Products on your account as an additional authorized user. Another example is if you opt to share a camera’s video stream with the authorities or other authorized users. By selecting this option in our web application, you consent to this act of sharing.

 

For external processing
 
We have vendors, service providers, and technicians who help with some of our processing and storage, including helping to answer your questions. They may also assist with monitoring our servers for technical problems.
These technicians (as well as Survail employees) can access certain information about you or your account in connection with this work but these technicians are not allowed to use this data for non-Survail purposes. We also have strict policies in place to prevent unauthorized employee access to video and audio data.

 

As part of business transitions
 
Upon the sale or transfer of the company and/or all or part of its assets, your personal information may be among the items sold or transferred. We will request a purchaser to treat our data under the privacy statement in place at the time of its collection.
 
For legal reasons
 
We may provide information to a third party if we believe in good faith that we are required to do so for legal reasons. For example, we may disclose information in response to legal process and we may disclose information in response to lawful requests by public authorities in the United States and other countries for the purposes of law enforcement and national security.
 
We may share non-personal information (for example, aggregated or anonymized customer data) publicly and with our partners. For example, we may publish trends about security camera use in a particular industry segment. This information may also be shared with other users to help them better understand their energy usage compared to others in the Survail community, raise awareness about safety issues, or help us generally improve our system. We may also share non-personal information with our partners, for example, if they are interested in providing demand-response services or other incentive programs. We take steps to keep this non-personal information from being associated with you and we require our partners to do the same.
 
If you select an outside party for the purchase, installation, or service of your Survail device and share your personal information, we cannot control the collection, storage or sharing of information collected by that party. For example, if you buy a Survail camera from a reseller, the reseller may collect personal information as part of the transaction. Or the party that installed the device may retain information that you provided to them to assist them in servicing the device if needed. Always check the privacy policies for any company that collects your personal information.
 

What choices do I have and how can I delete my personal information?

 

Survail generally stores your personal information on Survail’s servers until you delete or edit it, or for as long as you remain a Survail customer in order to provide you with Survail Products.

 

As described above, some information is processed and stored directly on the Survail device. All personal information is encrypted as it is transmitted to Survail and cannot easily be accessed.

 

You can delete the information on the Survail device by resetting it to the defaults. If you delete your Survail organization, all the data associated with your organization’s Survail account is likewise deleted. Please contact Survail Support at support@Survail.com if you have questions regarding how to accomplish this.  

 

You can access, amend or delete your personal information from Survail’s servers through the controls in your Command account. Because of the way we maintain certain services, after your information is deleted, backup copies may linger for some time before they are deleted, and we may retain certain data for a longer period of time if we are required to do so for legal reasons.

 

EU-US and Swiss-US Privacy Shield Frameworks

 

As described in our Privacy Shield certification (available at https://www.privacyshield.gov/list, search for “Survail”), Survail complies with the EU-US and Swiss-US Privacy Shield Frameworks as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland, respectively. Survail remains responsible for any of your personal information that it shares under the Onward Transfer Principle with third parties for external processing on our behalf, as described in the section of this Privacy Statement entitled, “In what circumstances does Survail share my information?” In certain situations, Survail may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Survail is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. Please contact us with any questions or concerns regarding our privacy practices in relation to our Privacy Shield certification. If we are unable to resolve your concerns you may contact (free of charge) our U.S.-based third party dispute resolution provider by clicking here. Under certain conditions more fully described on the Privacy Shield website, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.

 

 

Can Survail’s Privacy Statement be changed?

 

Yes, this Privacy Statement may change from time to time. We make efforts to provide notice of any changes on the Website or by contacting you, but you can always reference this statement on the Website.
